(dismissed as suspect) As investigators we must, "follow & respond to ALL "facts in evidence"- even when inconvenient!" As a general ruling/guidline - such use of proper pull-up R upon UART_TX IS recommended... Yet - based upon the evidence on hand - the "absence of pull-up R @ UART_TX" - appears to escape, "Judgement as Guilty" - at this time - and in this place!"
